Landowner Issues In Condemnations |

Most landowners are aware that their property may be taken by governmental agencies by the proper exercise of the power of eminent domain: condemnation. In most cases the only real issue is valuation. The right of the condemnor to take the property is usually clear, and the concern of the owner - the condemnee - is how much the land, perhaps with improvements, is worth. There are many issues relating to valuation, but before landowners get to that point in the condemnation process, they typically want answers to a number of basic questions, such as these:
1. who has the power to condemn? 2. for what purposes can land be taken? 3. what limitations exist on the exercise of the power to condemn? 4. can landowners place any limitations on the purpose for which the land is taken or on the amount of land taken?
This article will provide short answers to the above questions, not to discuss them in depth, to provide to the landowner some insight into the condemnation process.

The Legal Community's Cure For Bad Apples |

In the legal profession, as with any profession, there are good lawyers and bad lawyers. Unfortunately, we sometimes hear stories of clients being victimized by their lawyers. It can happen in several ways. For example, a client can retain an attorney to do various work, and the attorney will accept the retainer and never do as promised. We have heard of stories where lawyers settle a case for a client but then never provide the settlement funds to the client. Many harmed clients are aware of grievance procedures that can be filed with the State Bar of Texas against the lawyer. However, many clients are not aware that the State Bar of Texas offers a Client Security Fund to try to assist injured clients recover monies taken by their attorneys..

Texas Legislature Winding Down Session |

As is the normal practice, the Texas Legislature will approve many new laws and amendments of existing laws in the last days of the 80th Legislative Session. Then Governor Perry will have additional time to decide to sign or veto the legislation. In fact, some of the most important and far- reaching bills are sent to the Governor at the end of the session. For instance, House Bill 3928 will, if it makes it through the legislative process, make "technical amendments" to the margin tax approved in 2006. We will prepare a report to you in the next newsletter on HB 3928 and some of the other bills.
Nevertheless, a week before the end of the session, some bills have made it through the legislative process and will be effective immediately or, more typically, on September 1, 2007.
